Terms of Service

Welcome to CalClick. These terms are a binding agreement between you and PONPON ("we", "us"). Using the app means you accept them. If you do not accept them, do not use the app.
1. Eligibility and age
The service is intended for people aged 16 and over. If you are under 18, your use requires the consent of a parent or guardian. By using the app you confirm that you meet the age requirement and that the information you have given us is accurate.
2. What the service does
CalClick lets you photograph a meal, identifies its ingredients using artificial intelligence, estimates its calories and nutritional values, and keeps a food diary, a daily target and a progress record for you. You can also log workouts and water, record weigh-ins, and link a coach who can view your progress.
3. What the service is not — the most important section here
3.1 This is not medical advice
CalClick is not a medical device and does not provide medical, nutritional or any other professional advice. Its content is general information only, and it is no substitute for diagnosis, treatment or advice from a physician, a clinical dietitian or another qualified professional.
Consult a professional before changing your diet or your physical activity, and particularly if you are pregnant or breastfeeding, under 18, managing diabetes, heart disease, kidney disease or another medical condition, taking medication, or have a history of an eating disorder. Do not disregard medical advice, and do not delay seeking it, because of something you read in the app.

3.2 The numbers are estimates
Recognition from a photograph and the nutritional values that follow are produced automatically by artificial intelligence models and third-party food databases. They may be wrong, incomplete or inaccurate. Portion size, cooking oil, sauces and ingredients hidden from the camera all affect the result, sometimes substantially. It is your responsibility to review the result and correct it before saving.
3.3 Do not rely on the app for allergens
Never use CalClick to decide whether a food is safe for you in terms of allergy, intolerance, religious dietary law or any other dietary restriction. The app does not detect allergens, and a recognition error could be dangerous. Rely on the product label and on whoever prepared the food.
4. Your account
You are responsible for keeping your sign-in details safe and for everything done through your account. If you suspect unauthorised access, change your password and contact us immediately.
Guest accounts: you may use the app without signing up, but a guest account is tied to one installation and cannot be recovered. Deleting the app or moving to another device destroys your access to it permanently. We cannot restore a guest account and are not liable for data lost this way.
5. Subscriptions, trials and payments
5.1 The plans
Automatic analysis requires a paid subscription. The available plans:

The binding price is the one shown in the App Store or Google Play purchase sheet at the moment of purchase, according to your store and country. The prices above are the Israeli prices as at the date of this document and may change.
5.2 Automatic renewal
Your subscription renews automatically at the end of each period unless you cancel. Payment is charged to your App Store or Google Play account within the 24 hours before the current period ends, at the full plan price.
5.3 Cancelling
- Cancellation happens in the store, not in the app. On iOS: Settings → your name → Subscriptions. On Android: Google Play → Subscriptions.
- You must cancel at least 24 hours before the period ends, or it renews.
- After cancelling, access continues until the end of the period you paid for.
- Deleting the app or deleting your account does not cancel your subscription.
5.4 Free trials
A free trial, where offered, converts automatically into a paid subscription at its end unless cancelled at least 24 hours beforehand. Trials are limited to one per user and per store account. If you buy a subscription during a trial, the unused part of the trial is forfeited.
5.5 Refunds
Payment is collected by Apple or Google, not by us. Refund requests go to them and follow their policies — reportaproblem.apple.com or Google Play support. We cannot issue a refund ourselves. There is no refund for a period already used, except where Israeli consumer law requires otherwise.
5.6 Price changes
We will give notice before changing the price of an existing subscription, and you will be able to cancel before it takes effect.
6. Acceptable use
You may not use the service to: break the law; attempt to break into, take apart, reverse engineer or circumvent technical limits; run automated tools against it or scrape data from it; upload offensive, sexual or harmful images, or images of other people without their consent; share an account or transfer a subscription; or place unusual load on the infrastructure.
We may rate-limit usage to prevent abuse.
7. Your content
The photographs and data you upload remain yours. You grant us a limited, non-exclusive licence to store, process and display them solely in order to operate the service for you, and to share them with a coach you linked yourself.
We do not use your content to train artificial intelligence models, and we do not sell it. The licence ends when you delete the content or your account.
You confirm that you have the right to upload every image you upload.
8. Sharing with a coach
An invitation code grants read-only access to your progress data. Give it only to someone you want to see it, and revoke it when it is no longer needed. A coach does not act on our behalf, and we are not responsible for the advice they give you or for what they do with information you chose to reveal to them.
9. Third-party services
The service relies on Google Firebase, Google Vertex AI, RevenueCat, Sentry, Apple HealthKit and the app stores. Your use of those is also subject to their own terms, and we are not responsible for their availability or their conduct.
10. Intellectual property
The app, its design, its code, its name and its logo belong to us or to our licensors and are protected by intellectual property law. These terms grant you no rights in them beyond a personal, limited, non-transferable and revocable licence to use the app for your own private purposes.
11. Availability and changes to the service
The service is provided as is. We may change, add to, limit or discontinue features. If we retire a material feature that a paid subscription depends on, we will give notice in advance and allow cancellation.
12. Disclaimer of warranties
To the fullest extent permitted by law, the service is provided without warranty of any kind, express or implied, including any warranty of fitness for a particular purpose, uninterrupted availability, the accuracy of nutritional values, or any outcome whatsoever in weight, health or fitness.
No result is guaranteed to you. Outcomes depend on many factors outside our control.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, or for loss of profits, goodwill or data. Our total liability on any cause of action will not exceed the amount you paid us in the 12 months preceding the event, or ₪400 if you paid nothing, whichever is greater.
This limitation does not apply where the law does not permit it to, including fraud, wilful misconduct, or personal injury caused by our negligence.
14. Indemnity
You will indemnify us for damage we suffer as a result of your breach of these terms, your unlawful use of the service, or content you uploaded in violation of someone else's rights.
15. Termination
You may stop at any time — delete your account and cancel the subscription in the store. We may suspend or close an account that breaches these terms or is used abusively, and in a serious case without prior notice. Sections 3, 7, 10, 12, 13 and 14 survive termination.
16. Apple and Google
These terms are between you and us alone; Apple and Google are not party to them. They are not responsible for the app, the software, support, or any claim relating to them, and they are third-party beneficiaries entitled to enforce these terms against you. Any question about the app goes to us, at the address at the end of this document.
17. Changes to these terms
We will update these terms from time to time. A material change will be brought to your attention inside the app at least 7 days in advance. Continuing to use the service after a change takes effect means you accept it.
18. Governing law and jurisdiction
These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction. If you are a consumer resident in a country whose law grants you mandatory protection, nothing here takes that away from you.
19. General
If any provision is found unenforceable, the rest remain in force. Failing to enforce a right is not a waiver of it. You may not assign your rights; we may, as part of a transfer of the business. These terms and the privacy policy are the entire agreement between you and us.
